Terms of Use
These Terms of Use (“Terms of Use”) apply to all uses of and visits to UnitedMilitaryClassifieds.com, and your use of UnitedMilitaryClassifieds.com is conditioned on your acceptance of the terms and conditions contained in these Terms of Use and our Privacy Policy (“Privacy Policy”), accessible from our home page. Your use of UnitedMilitaryClassifieds.com constitutes your binding agreement to and consent of these Terms of Use and our Privacy Policy. We reserve the right to modify these Terms of Use from time to time without notice, and we encourage you to review them often.
1. United States Law.
You must be at least 18 years of age and a legal resident of the United States (“U.S.”), or an entity registered to do business in the U.S., to participate in any activity that requires you to provide your personal information on UnitedMilitaryClassifieds.com. Our services are tailored for U.S. audiences and are governed by and operated in accordance with U.S. law. We make no representation that UnitedMilitaryClassifieds.com is operated in compliance with the laws of any other nation. Please be aware that any personal information you transfer to us will be transferred to the U.S and subject to U.S. law. By using UnitedMilitaryClassifieds.com and/or providing us with your personal information, you certify that you are at least 18 years of age and a resident of the U.S., or an entity registered to do business in the U.S., and consent to the transfer of personal information to the U.S., and waive any claims that may arise under the laws of other nations.
2. Buyers and Sellers; Responsibilities.
UnitedMilitaryClassifieds.com displays advertisements for the sale of certain goods (“Classifieds”) submitted by users of UnitedMilitaryClassifieds.com (“Sellers”) for purchase by other users of UnitedMilitaryClassifieds.com (“Buyers”). The structure for the online display of Classifieds corresponds to United States government installations and facilities and may also be used to display classifieds for other U.S. areas and cities. We do not guarantee, endorse or warrant any Buyer or Seller. Our Classifieds service allows Buyers to browse the Classifieds submitted by Sellers and to contact Sellers about purchasing items advertised for sale. We have no responsibility or liability whatsoever to either Buyers or Sellers for such transactions. It is Buyers’ sole responsibility to investigate and evaluate any Seller before purchasing an item from the Classifieds, and to negotiate the terms for any item to be purchased, including ascertaining whether the Seller owns and has the right to sell such item.
Prior to placing any Classified advertisement, Sellers must certify that the sale of the item involved does not violate any United States law or any rule or policy of UnitedMilitaryClassifieds.com. We reserve the right to reject or remove any Classified advertisement in our sole discretion. We may terminate the accounts of users who submit Classifieds we deem inappropriate, in our sole discretion. Buyers and Sellers are entirely responsible for the content of their Classifieds.
You understand, acknowledge and agree that United Military Classifieds, LLC (“UMC”) merely provides a forum (the UnitedMilitaryClassifieds.com website) where anyone can offer, sell or buy certain items, on terms of sale determined solely by the Buyer and Seller. Unlike an auction web site, UMC is not involved in any actual transaction between Buyers and Sellers, and ultimately has no control over the quality, safety or legality of advertised items, nor any matters relating to the shipment, taxation, or completion of transactions. UMC shall not be held liable for any loss or damage of any sort incurred as a result of Classifieds posted on UnitedMilitaryClassifieds.com.
3. Registered Users.
Buyers and Sellers are granted the right to post Classified advertisements at no charge when they complete our registration process and are accepted as registered users (“Registered Users”) of UnitedMilitaryClassifieds.com. Registered Users will be charged a fee to highlight (“Highlight Fee”) a Classified advertisement for additional service options. All Highlight Fees will be non-refundable in the event a Classified is removed from UnitedMilitaryClassifieds.com for violation of these Terms of Use, any rule of UnitedMilitaryClassifieds.com or any applicable law. Registered Users may be individuals, partnerships, companies or other entities.
4. No Unlawful or Prohibited Use.
You may view, download and print information from UnitedMilitaryClassifieds.com for your personal use only, but you may not remove any trademark, copyright, or notice appearing there. You may not copy, alter, share, reuse, resell, license, create derivative works from or transfer materials from UnitedMilitaryClassifieds.com for any other reason, without prior written permission from UMC.
All links to UnitedMilitaryClassifieds.com must appear as hypertext, without use of UMC’s logos or trademarks. You may not use a hyperlink to present materials on UnitedMilitaryClassifieds.com as your own. Deep-linking is strictly prohibited unless approved by UMC in writing (a deep-link is a hyperlink that bypasses a website’s home page and brings a visitor directly to an interior page). You may not frame UnitedMilitaryClassifieds.com or any content provided by UMC (framing is an alternative form of linking that allows viewing of a linked web page within a “frame” of the original website). You may not use UMC’s url’s, trademarks, copyrighted materials, or attempt to effect any “matchmaking” advertising by third parties.
You may not use UnitedMilitaryClassifieds.com for any unlawful or prohibited purpose. You may not use the information or content provided on UnitedMilitaryClassifieds.com in a way that may suggest any connection with or endorsement of any product or service, or which violates any property, privacy or other rights. If you choose to use UnitedMilitaryClassifieds.com, you do so at your own risk and are responsible for compliance with any applicable local laws.
5. Use of Bulletin Boards, Chat Rooms and Other Communication Forums.
Information posted in Classifieds, bulletin boards, blogs, chat rooms, e-mail messages and other forums may be posted, read and collected by members of the general public – please use caution in posting and/or using any such information. UMC is not responsible for messages, images, text or other materials submitted on such forums. You may only use these forums for appropriate, related content. When using a forum, you may not: (a) use language to defame, abuse, harass, stalk, threaten or violate the legal rights of others; (b) publish, post or circulate any defamatory, abusive, harmful, discourteous, infringing, obscene, pornographic, profane, indecent, malicious, threatening or unlawful material or information; (c) upload content that infringes on any copyright, trademark, patent, or other proprietary rights of others; (d) upload files that contain viruses, worms, trojan horses, time bombs, corrupted files, or any other software or program that may damage, disable, overburden or impair the operation of another’s website, computer or network; (e) falsify the origin or source of content; or (f) advertise or offer to sell any goods and services, or conduct or forward surveys, contests or other promotions without the express written consent of UMC.
6. Payments.
When you post Classifieds and pay Highlight Fees on UnitedMilitaryClassifieds.com, we may request your name, address, telephone number, e-mail address and certain billing information. This information allows us to verify the authenticity of users and to respond to billing questions. Credit card, debit card or other account information will be collected by a third party operational service provider to conduct the financial transaction in a secured manner; the third party payment site will be accessible via a hyperlink from UnitedMilitaryClassifieds.com, or one of our affiliate websites, and the third party payment site owner will be solely responsible for all financial transactions and the collection, use, and storage of your personal and financial information.
7. Advertisers.
Third party advertisers ("Advertisers") may present statements, messages, offers, advice, or promotional materials on or through UnitedMilitaryClassifieds.com, or one of our affiliate websites. We do not control or endorse any Advertisers. Any dealings with Advertisers found on or through UnitedMilitaryClassifieds.com or one of our affiliate websites, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the Advertisers. UMC and its managers, officers, members, affiliates, employees, agents, representatives, suppliers and contractors (all of the foregoing, collectively, the "Representatives") shall not be liable for any loss or damage of any sort incurred as a result of any Advertisers on UnitedMilitaryClassifieds.com or affiliate websites.
8. License Grant.
You grant UMC a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, copy, modify, display, archive, store, distribute, reproduce and create derivative works from all content provided to UnitedMilitaryClassifieds.com, in any form, media, software or technology of any kind now existing or developed in the future. Without limiting the generality of the foregoing, you authorize UMC to include the content you provide in a searchable format that may be accessed by guests of UnitedMilitaryClassifieds.com and other websites and search engines. You further grant UMC permission to use any information, suggestions, ideas, drawings or concepts communicated for any purpose, commercial, public or otherwise, without the need for additional compensation of any sort to you. By posting or submitting content to UnitedMilitaryClassifieds.com, you also warrant and represent that you own or otherwise control all of the rights to the content of the public posting or Classified, and that use of your content by UMC will not infringe or violate the rights of any third party. UMC reserves the right to: (i) review at any time and to delete any content that may be deemed inappropriate or appear to be in violation of these Terms of Use; and (ii) block an individual entirely if such individual’s use of UnitedMilitaryClassifieds.com is deemed inappropriate by UMC in its sole discretion.
9. WARRANTY DISCLAIMER.
UMC AND THE REPRESENTATIVES MAKE NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO UNITEDMILITARYCLASSIFIEDS.COM, ITS CONTENT OR THE SUITABILITY OF THE INFORMATION, PRODUCTS AND SERVICES CONTAINED ON UNITEDMILITARYCLASSIFIEDS.COM FOR ANY PURPOSE. ALL SUCH ITEMS ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. UMC AND ITS REPRESENTATIVES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT WITH RESPECT TO UNITEDMILITARYCLASSIFIEDS.COM AND ANY WEBSITE WITH WHICH IT IS LINKED. UMC ALSO MAKES NO REPRESENTATIONS OR WARRANTIES AS TO WHETHER THE INFORMATION ACCESSIBLE VIA UNITEDMILITARYCLASSIFIEDS.COM, OR ANY WEBSITE WITH WHICH IT IS LINKED, IS ACCURATE, COMPLETE OR CURRENT. IT IS YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY AND COMPLETENESS OF ALL INFORMATION, OPINIONS AND OTHER MATERIAL ON UNITEDMILITARYCLASSIFIEDS.COM OR ANY WEBSITE WITH WHICH IT IS LINKED.
10. LIMITED LIABILITY OF UMC AND UNITEDMILITARYCLASSIFIEDS.COM.
IN NO EVENT SHALL UMC OR ITS REPRESENTATIVES BE LIABLE FOR ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, LOSS OF USE, LOSS OF DATA, LOSS CAUSED BY A COMPUTER OR ELECTRONIC VIRUS, LOSS OF INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY), CLAIMS OF THIRD PARTIES, OR OTHER LOSSES OF ANY KIND OR CHARACTER RELATED TO THE USE OF UNITEDMILITARYCLASSIFIEDS.COM OR ANY WEBSITE WITH WHICH IT IS LINKED, OR FOR ANY INFORMATION, PRODUCT OR SERVICE OBTAINED THROUGH UNITEDMILITARYCLASSIFIEDS.COM, EVEN IF UMC OR ANY OF ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. INDEMNIFICATION.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS UMC AND THE REPRESENTATIVES FROM AND AGAINST ANY CLAIMS, ACTIONS, COSTS, EXPENSES, OR DEMANDS, INCLUDING, WITHOUT LIMITATION, REASONABLE LEGAL AND ACCOUNTING FEES, RESULTING FROM ANY CONTENT YOU SUBMIT, POST TO OR TRANSMIT THROUGH UNITEDMILITARYCLASSIFIEDS.COM, YOUR USE OF UNITEDMILITARYCLASSIFIEDS.COM, YOUR VIOLATION OF THESE TERMS OF USE, YOUR VIOLATION OF ANY RIGHTS OF ANOTHER, OR OTHERWISE ARISING OUT OF YOUR USE OF UNITEDMILITARYCLASSIFIEDS.COM IN ANY WAY. WE RESERVE THE RIGHT TO TAKE EXCLUSIVE CONTROL AND DEFENSE OF ANY SUCH CLAIM SUBJECT TO INDEMNIFICATION BY YOU, IN WHICH EVENT YOU WILL COOPERATE FULLY WITH UMC IN ASSERTING ANY AVAILABLE DEFENSES.
12. Legal Notice and Acceptance of Terms of Use and Privacy Policy.
By using UnitedMilitaryClassifieds.com, you acknowledge that you have read these Terms of Use and our Privacy Policy, and agree to all their terms and conditions. If you do not agree, please do not use UnitedMilitaryClassifieds.com.
By using UnitedMilitaryClassifieds.com after our Terms of Use have been revised, you indicate your acceptance of - and agree to be bound by - the revisions. UnitedMilitaryClassifieds.com is created and controlled by UMC in the State of Florida, and these Terms of Use are governed by the laws of the State of Florida (excluding any applicable conflict of laws provisions). The exclusive jurisdiction and venue concerning all disputes arising out of or relating to these Terms of Use or use of UnitedMilitaryClassifieds.com shall be Bay County, Florida.
UnitedMilitaryClassifieds.com and its contents are the property of UMC and are protected, without limitation, by U.S. and foreign copyright and trademark laws. UnitedMilitaryClassifieds.com is a service mark of UMC. Other titles, logos, designs, products, services and company names displayed on UnitedMilitaryClassifieds.com may be trademarks and/or service marks of their respective owners.
13. No Waiver.
The failure of UMC to enforce any provisions of these Terms of Use or respond to a breach by you or other parties shall not in any way waive its right to enforce subsequently any terms or conditions of these Terms of Use or to act with respect to similar breaches.
14. Termination.
UMC reserves the right, in its sole reasonable discretion, to terminate your access to all or any part of UnitedMilitaryClassifieds.com at any time without notice.
